1. Operator
The accommodation service is provided by Ubytování Kvilda s.r.o., Company ID 29902622, not registered for VAT, registered office at Zdíkovec 19, 384 73 Zdíkov, registered with the Regional Court in České Budějovice, section C, file 36873 (“the accommodation provider”). Email: info@upickukvilda.cz, telephone: +420 602 883 385. The accommodation is provided at Kvilda 125, 384 93 Kvilda, Czech Republic.
2. Booking and formation of contract
The guest selects a room, dates, actual number of staying guests and payment method, enters contact details and the statutory registration details of every staying person, and reviews the final price. A room may be booked for fewer guests than its capacity. In normal operation, submitting the clearly labelled button “Book with an obligation to pay” constitutes a binding order. A button labelled as a non-binding test order does not create a binding order.
In July and August and from 26 December to 3 January, the minimum stay is 4 nights. In June and September and from 4 January to 14 March, the minimum stay is 3 nights. A shorter stay is available only if it exactly fills a shorter vacant gap between two occupied periods for the same room. For a stay crossing seasons, the higher minimum applies.
After submission, the room is held temporarily for the period stated in the email. The automatic receipt of an unpaid booking is not confirmation of the stay. The accommodation contract is formed when the guest receives final confirmation after full payment, or a separate explicit confirmation from the provider. The confirmation and these terms are sent by email on a durable medium.
3. Price and payment
All actual staying guests, including children, must be registered before arrival, up to the room capacity. If initially only one or two people are entered, the booker acknowledges that any additional guests must be added using “More about your booking” in the booking email, before check-in at 3 pm. There is no obligation to fill all beds. Adding guests does not increase the room price. Any extra local stay fee is displayed before payment and paid online by card; exempt guests are added free of charge. The original booking must be paid first. A paid addition is completed only after the bank verifies its payment. The original confirmed booking and invoice remain unchanged; a separate receipt is provided for the fee supplement.
The final price is displayed in Czech crowns before submission. The provider is not registered for VAT. The basic room rate is charged per room and night, regardless of whether the full capacity is used. A one-off surcharge of CZK 1,000 per room applies to a one-night stay. The price also includes Kvilda’s local stay fee of CZK 25 per actually accommodated person and night, unless that person is exempt by law. Exemptions are reflected from each guest’s details.
Payment can be made by card through the ČSOB payment gateway or by bank transfer according to the instructions in the email. Card details are processed solely by the payment gateway and are not stored by the provider.
For card payment, the room is held for no more than 10 hours. The guest receives a secure link to retry an interrupted payment and, when the arrival date permits, to change to bank transfer.
For bank transfer, the room is held for 3 days. Full payment must be credited to the provider’s account before the deadline. A reminder is sent during the last 24 hours. Bank transfer is unavailable when arrival is within the following seven days; those bookings can only be paid by card.
If full payment is not received by the deadline, the booking expires automatically and the room is released. After payment, the guest receives the final booking confirmation and invoice by email. The provider may exceptionally extend the deadline by prior agreement.
4. Cancellation terms
- more than 30 days before arrival: no cancellation fee,
- 15–30 days before arrival: 50% of the stay price,
- less than 15 days before arrival or no-show: 100% of the stay price.
The time when cancellation reaches info@upickukvilda.cz is decisive. Any amount due under these terms is returned by the original payment method, normally within 14 days.
5. Right of withdrawal
Under Section 1837(j) of the Czech Civil Code, a consumer does not have a 14-day right to withdraw without giving a reason from a contract for accommodation provided on specific dates. This does not affect rights arising from defective performance or the contractual cancellation terms above.
6. Arrival, departure and house rules
The room is available from 3 pm on the arrival date. The key will be placed in your room’s lockbox on the wooden post to the left of the entrance steps, so no latest arrival time is set. The room must be vacated by 10 am on departure unless agreed otherwise. Return the key to the brown mailbox below the key lockboxes. Meals are not provided and pets are not permitted. Extra beds and baby cots are not available. The guest is liable for damage demonstrably caused by the guest or people admitted by the guest.
Detailsed rules for using the rooms and shared areas are available in the house rules, including a printable PDF.
7. Complaints
If the service does not have the agreed qualities, the guest should report the issue without undue delay so that it can be remedied. A complaint may be made in person, by email or by post to the registered office. The provider will confirm receipt and handle it without undue delay, no later than 30 days unless a longer period is agreed.
8. Alternative dispute resolution
If a consumer dispute cannot be resolved directly, the consumer may contact the Czech Trade Inspection Authority, Central Inspectorate – ADR Department, Gorazdova 1969/24, 120 00 Prague 2, email adr@coi.gov.cz, coi.gov.cz/informace-o-adr/.
9. Final provisions
The contract is governed by Czech law. It may be concluded in Czech or English; if the versions differ, the Czech wording prevails. The terms delivered to the guest for the particular booking apply.
